He should be charged DUI, on expired tags and without insurance. He’ll likely have his license suspended. If this is his first DUI, he probably WON’T do jail time.

I hope the prosecuting attorney for where you live goes after who ever let him drive the car!
Letting some one who is a known drinker drive a car drunk is considered a crime in a lot of places.
Not only does your friend (?) belong in jail, they do too!
Be glad there was no accident involved and or loss of life.

It looks to me like he will have to go to traffic court and his sentence will be determined there. I think it would be wise for him to get a lawyer. He will probably have to pay a big fine, and the owner of the car is probably in trouble if he gave your friend permission to use the car.

As each state is different it really depends on the state you in which this happened. Law enforcement agencies take driving under the influence of alcohol serious especially around the holidays and I have often seen judges take a strong view in the court room lately. Even though the car was not his, your friend is responsible if he is behind the wheel, when we take a car on the road we have an obligation to make sure we are covered on insurance, making sure car is road worthy and such. The person who loaned him the car could also be held responsible for not having insurance or for the car being properly registered and tagged. If this is a first offense usually the court will take this into consideration and often they will order the person to attend classes to try to prevent future DUI’s .

what should happen is they take his car and license fine him about a 1000 bucks and let him sit in jail a few days to think about how stupid he is

As I have learned from my brothers many incarcerations.. he will probably do some jail time.. He will most likely have probation also. Possibly some community service. All in all, he isn’t a very responsible friend. He is out there putting other peoples lives in danger when he is behind the wheel of a vehicle intoxicated. My advice to you: find some different friends.

Better to be in jail and still alive let alone not having killed some innocent people in other cars or pedestrians. What a fool to drive under the influence, and worse, without insurance.
It is the driver’s responsibility to make sure the car they Drive, even if it is not theirs, is registered and insured for them to drive it. That is what being responsible is about.
