It would still be a DUI.

I once got one. I was just at the limit and drove over a hill. There was this utterly wasted dude would was passed out at the green light. I got a DWI.

Of course my hitting him woke him up. Now the other guy paid up eventually. But since I had been charged as well it took months to get his insurer to agree to pay up. If the other driver had been sober I would have had a hard time proving it was his fault in court.

As far as how long they keep you. Some places do it differently and it depends on the circumstance. Some places will let you bond right out. Some will just let you out in the morning even if you did not post bond. But some will keep you until your court date unless you post bond.

Some places have much higher fines and penalties if you were caught while involved in an accident.

Just because the drunk got hit, doesn't make him not a drunk.

DUI is DUI, no matter what the situation is.

Hopefully a very long time since a driver like that crossed the center line and hit and killed my best friend almost 3 years ago. I was states away when it happened, but he killed a big part of me too that night, my life is forever saddened. Rest in Peace Kim, love and miss ya dear friend.

DUI and the accident can be blamed on the drunk even if she was stopped at a light, a DUI is a DUI regardless

DUI.

If you're driving while drunk, you're driving while drunk. It makes no difference whether someone else caused the accident.
