Driving under the influence question?
My sister recieved a DUI not too long ago because she was under medication while drivng. She was on her way to the hospital btw. She is going to court on this upcoming tuesday. Can they sentence her to jail if it was her first dui? We also live in california.

CAN they? Yes.
WILL they? Probably not.
Yes, thay can sentence her to jail and it depends on what mood the judge is in that day and I will be praying for her because if she was trying to get to the hospital that is a hold different story!

Can they yes, will they no. Laws are so dumb, you got drunk drivers with like 5 DUI’s who don’t go to jail. Your sister will not go to jail for a first time DUI.
Also you dont explain enough about what medication but if it were someoen els’es medication or prescriptions meds she doesn’t have presrictions for thats bad but if its her own medication that should lean in her favor as well.
IMO, it’s very unlikely that your sister will get any jail time.
Being “high” on prescription drugs is very different from being high on alcohol. Your sister can claim she didn’t realize she was impaired by her drugs (which could be true).
Tell your sister to hire a good DUI lawyer. It will cost her some money, but what most people don’t know is that a DUI conviction will run your automobile insurance costs through the roof. I had a friend in North Carolina whose husband had a DUI many years ago. It was a first offense and he got the usual nominal penalties. But his automobile insurance premiums went up from something like 450.00 to well over $4,000 a year. And it was expected to take about 10 years for his insurance premiums to drop to normal.
Automobile insurance is the real “killer” to the driver in a DUI case. With the premium increase, you could buy a new, high-end BMW if you didn’t have to pay it.
If your sister is convicted, tell her to talk to her lawyer about what a second offense might mean. She won’t be able to afford to eat, much less drive. In most states, the DUI laws are tough and getting tougher.
After my friend’s husband had his DUI experience more than 20 years ago, I made it a point not to drive after drinking. As it turned out, I may have saved my life. I was shooting down Highway 77 from Mooresville to Charlotte, NC, late one night after a party. I usually drank a good bit at those parties. I didn’t that night. It was the best decision I ever made.
