If someone owes you child support and that person is willed money?

Do they have to pay up their child support from that inheritance?
I know that if they get income tax monies that they have to pay their back child support with their return. My ex husband hasn’t ever paid any of his child support to me and he will eventually get inheritance money from his Mom and StepFather’s estate.
Would I be entitled to the money as well for back child support ?

Yes but you need to get an attorney and enter a judgement against him. If you truly cannot afford an attorney go to social services and they will get you one free of charge.

Also, you can have his wages garnished or even arrested if he does not pay.

I had a friend who was arrested for not paying alimony so child support is a huge issue!

You are entitled to back child support, not the inheritance. Go to Family Court.

Yes if you are owed child support you would need to get an attorney to make sure that you get your back support.

You would not “automatically” be entitled to a piece of the inheritance like you are with income tax refunds.

Wait until the people die before you worry about this avenue. There probably won’t be an inheritance anyway until they are both dead. Suppose one of them dies 10 years from now and the other dies 25 years from now? You’re kids will be grown and gone anyway.

Take your ex to court and go about legally garnishing his wages. If you’re waiting for 2 people to die to collect child support, you might be waiting for a long, long time.
