You would be charged with two different things: 1) Driving without a license> usually a punishment of usually a $1000 fine and 10 days in jail. 2) Driving under the influence of alcohol> 24 hours in jail plus a huge fine. You'll also be prohibited from obtaining a drivers license for at least 2 years. Jurisdictions may differ...but what I just said is what will for sure happen in the State of Georgia. But likely, in any other state, you'll get something like that, assuming it's your first offense. It’s not like there is such a charge as driving under the influence without a license. The DMV doesn't assign points or fine you. The courts do that, and you pay the fines to the court. You would get a ticket for DUI and failure to carry your license if you actually had one but weren't carrying it, or driving without a license if you don't have one at all.
