what is the procedure for driving under the influence of marijuana charges? just read details for a thumbs up?

say im driving while high in one of the 15 states that has a penalty for driving under the influence of marijuana. how do they test that?

is it a urine test? and if it is, how can they prove that i was high at the time i was driving since it lasts for weeks? and if its a blood test, how long does it last in my system? what happens if i refuse to give blood?

i understand that if you get an alcohol DUI that you have an hour after arriving at the station where you MUST give a toxilyzer, the court-approved BAC tester, and if you refuse it, in NC at least, you lose your license for a certain period of time. is there a penalty like this for DUI with marijuana? i would think not, as that law was a late addendum for alcohol, but if i’m wrong, please correct me.

also, i ask that you not answer this question if you dont actually know what you’re talking about. if you just want points for answering, just type some gibberish and i’ll thumb it up. don’t talk out of your ass and confuse me if you’re as clueless about it if i am, please.
im positive that a urine test isnt condemning because it typically tests from 1-3 weeks, and they cannot prove that you were under the influence at the time you were driving.

and the penalty im referring to is when someone refuses to take a breathalyzer on site and refuses to take a toxilyzer at the station, resulting in suspension for a year. so obviously its not the same.

  1. INSOMNIAC says:

The penalty is the same for DUI regardless what substance you are under the influence of, if you refuse you can lose your license and in some states it is for 1 year, the test will be a combination of blood and urine and it doesn’t matter when it was ingested if it test positive then you are charged with DUI.~
