Will you be arrested if found to be driving under the influence of marijuana?

If you have no paraphernalia or marijuana on you? What if you are high, but still able to drive by results pending from a field sobriety test?

    Yes, you will be arrested. But if your under the influence and you are a passenger you won’t get arrested unless you posses the drug.

    will you be arrested for being “intoxicated” even though your last drink was 2 hours ago? Yes. Sames applies to any illegal drug, at least in California.

    State laws vary, but if after a field sobriety test an officer still suspects you’re driving while intoxicated s/he can request that you comply with a blood test. If you refuse you can be arrested and held until you can see a judge.

    By the way, if you are stopped for suspicion of DUI and you have NOTHING at all in your system, do not consent to a breathalyzer test. Request a urine or a blood test, because breathalyzer’s have been known to show false positives.

    If a cop suspects you are under the influence of any drug, legal or not you can be asked to submit to a blood test. Of you refuse to take the test that is as good as admitting to being “on some thing and you WILL loose your D.L. etc. Only in America the land of the free where our rights are at the discretion of Law enforcement.

    If you didn’t have any on you and passed the test it would be the same as having a few beers and passing the test. Of course if they took in for a blood test it would be your @ss. Beer isn’t illegal.

    D.U.I.C.S. = Driving Under the Influence of a Controlled Substance.

    If the cops have reasonable suspicion that you are driving while impaired (alcohol or CS) they can stop you and possibly force a blood draw. If they have Probably Cause that you are under the influence of marijuana –> arrested for D.U.I.C.S.

    Yes, driving under the influence of any drug is illegal. Even if you’re under the legal concentration limit, it is illegal if it impairs your ability to drive.

    Sure. You are under the influence of a controlled substance. Why do you think that should be different from alcohol? Do you drive drunk too?

    You need to explain what state you’re asking this about because DUI laws vary between states.

    In California, you cannot be arrested for driving while under the influence of marijuana unless your driving is impaired. If you’re driving like a regular drunk might drive (swerving all over the place, running into things, speeding, etc). You can be arrested in California for driving under the influence of *any* drug or alcohol, but in the case of drugs, it has to be shown that your driving was impaired. With alcohol, you can be driving just fine and still go to jail if you’re over the 0.08% limit.
